Red Flag Rules

Beginning in June of 2010, health care providers will be required to have systems in place to protect consumers from identity theft.  The "Red Flag Rules" of the Fair and Accurate Credit Transaction Act of 2003 impose these requirements.  Under the Act, service providers who receive payment for their services on a date separate from the date when the services are actually rendered are considered "creditors."  Because of the common practice in the medical industry of billing a patient's insurance, and then receiving payment from the insurer at some point in the future, many health care providers are bound by the requirements of the Fair and Accurate Credit Transaction Act.
